Terms of Service

Welcome to Vera Studio, Inc. ("Company," "we," "our," or "us"). Please read these Terms of Service ("Terms") carefully before using our Landscape Renovation Planner iOS application (the "App"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By downloading, installing, or using the App, you agree to comply with and be legally bound by these Terms. These Terms apply to all users of the App, including visitors, registered users, and contributors.

2. Description of Service

The App provides tools and resources to help users plan and visualize landscape renovations. Features may include design templates, plant databases, cost estimators, and other functionalities to assist in landscape planning.

3. Eligibility

You must be at least 18 years old to use the App. By agreeing to these Terms, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement.

4. User Accounts

• Registration: To access certain features of the App, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate.

• Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use of your account.

5. Intellectual Property

• Ownership: All content, features, and functionality of the App, including but not limited to text, graphics, logos, and software, are owned by the Company or its licensors and are protected by intellectual property laws.

• License: Subject to your compliance with these Terms, the Company grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App for personal, non-commercial purposes on your compatible iOS device.

6. User Content

• Responsibility: You are responsible for any content you upload, submit, or otherwise make available through the App ("User Content"). You retain ownership of your User Content but grant the Company a worldwide, royalty-free, non-exclusive license to use, reproduce, modify, and distribute your User Content as necessary to provide the App's services.

• Prohibited Content: You agree not to upload or distribute any User Content that is unlawful, harmful, defamatory, obscene, or otherwise objectionable.

7. Payments and Subscriptions

• Pricing: Some features of the App may require payment. All fees are non-refundable unless otherwise stated.

• Billing: Payments will be charged to your iTunes account upon purchase and will cover the selected subscription period. Subscriptions will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.

• Cancellation: You can manage and cancel your subscriptions through your iTunes account settings. Cancellation will prevent future charges but does not refund past payments.

8. Termination

We reserve the right to suspend or terminate your access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the App, us, or third parties, or for any other reason.

9. Disclaimers and Limitation of Liability

• Disclaimer: The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will be error-free or uninterrupted.

• Limitation of Liability: To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the App.

10. Indemnification

You agree to defend, indemnify, and hold harmless the Company and its affiliates, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses arising out of your use of the App or violation of these Terms.

11. Governing Law

These Terms and your use of the App are governed by and construed in accordance with the laws of California, without regard to its conflict of law provisions.

12. Changes to Terms

We may modify these Terms from time to time. We will notify you of any changes by updating the "Last Updated" date at the top of these Terms. Your continued use of the App after such changes constitutes your acceptance of the new Terms.

13. Privacy Policy

Your use of the App is also governed by our Privacy Policy, which can be found here. By using the App, you consent to the practices described in the Privacy Policy.
